This Terms & Conditions document governs the use of the website and the professional photography services provided by Photos by Aaron. By using the website or booking services, you agree to these terms.

SECTION 1 — ACCEPTANCE OF TERMS

  • Use of the website or services indicates acceptance of these Terms & Conditions.

  • By booking or paying a retainer, you acknowledge understanding and agreement.

  • Terms may be updated; continued use indicates acceptance of new terms.

SECTION 2 — SERVICES PROVIDED

Photos by Aaron provides professional photography services including, but not limited to:

  • Portraits (individual, couples, family)

  • Maternity & newborn sessions

  • Professional headshots

  • Beauty & fashion photography

  • Cake smash & children’s sessions

  • Events (birthdays, celebrations)

  • Weddings

  • Product & commercial photography

Note: Service descriptions, packages, and pricing are informational and may change. Availability is subject to confirmation.

SECTION 3 — BOOKING, FEES & PAYMENT

3.1 Fees

  • Fees for services will be agreed in writing.

  • Additional hourly rates apply for overtime: $150/hour pro-rated for two photographers and $125/hour pro-rated for one photographer.

3.2 Retainer

  • 50% of total fees due upon booking; non-refundable and can only be applied towards reschedulede session/event and/or gifted.

  • Retainer secures the date/time and credits toward total fees.

3.3 Remaining Balance

  • Remaining balance due on or before photo session/event.

3.4 Payment Method

  • Payments via e-transfer to info@photosbyaaron.com or cash.

  • Cheques must clear prior to image delivery.

  • Photographer reserves the right to withhold images until payment is received.

3.5 Optional Packages

  • Optional add-ons or packages may be purchased anytime before final image delivery.

SECTION 4 — CLIENT RESPONSIBILITIES

  • Ensure all necessary consents for venues, locations, and attendees are obtained.

  • Provide a safe and accessible on location environment for Photographer and staff.

  • Provide accurate session/event information, including times and locations.

SECTION 5 — PHOTOGRAPHER RESPONSIBILITIES

  • Provide all necessary equipment and photography staff.

  • Perform services professionally, safely, and efficiently.

  • Ensure Work Product meets professional standards.

SECTION 6 — EDITING & POST-PRODUCTION

6.1 Editing Style

  • Professional edits reflect Photographer’s style and portfolio.

6.2 Editing Scope

We offer a comprehensive and professional photo editing service (standard vs professional edits) that ensures your images look polished and flawless.
Standard Editing Process

Batch editing process which includes:

  • Cropping and geometry corrections

  • Lighting and white balance adjustments

  • Color correction and backdrop enhancements

  • Wardrobe wrinkle smoothing

  • Eye enhancements and teeth whitening

  • Facial feature adjustments and makeup applications

  • Facial reshaping and extensive skin retouching, including healing, mattifying, skin volume corrections, and skin tone balancing

  • Dodging & burning for perfect lighting contrasts

Professional Editing Process
In addition to our standard edits, we also offer a hands on professional retouching tailored to your specific needs, such as:

  • Flyaway hair removal

  • Head swaps, face swaps, and eye swaps

  • Body part swaps and weight reduction

  • Eye direction correction

  • Object and people removal or placement

  • Special requests (e.g., skin burn removal, tattoo removal, etc.)

6.3 Re-Edits

  • Standard batch edits = $125 for the batch

  • Standard edited image = $15 per image

  • Professional edited image = $20 per image

SECTION 7 — DELIVERY & DOWNLOAD

  • Images delivered via downloadable digital gallery or thorugh USB add-on. Digitalgallery is shareable with famiy and friends.

SECTION 8 — CANCELLATION, RESCHEDULING & REFUNDS

8.1 Client Cancellation

  • Retainer is non-refundable.

  • Large services such as weddings and events, written notice ≥30 days may allow retainer credit toward rescheduling.

  • Cancellations <30 days incur $75/hour penalty of scheduled coverage.

8.2 Photographer Cancellation

  • In emergencies or unforeseen events, Photographer may cancel; partial refund may be issued minus retainer.

  • Replacement photographer may be arranged where possible.

SECTION 9 — OVERTIME & DOWNTIME

9.1 Overtime

  • Charged at $150/hour pro-rated.

9.2 Downtime

  • Charged at $75/hour pro-rated in half-hour increments

  • Downtime charges not transferable to overtime

SECTION 10 — MARKETING & PROMOTIONAL USE / OPT-OUT FEE

Default Marketing Consent

  • By booking, the Client consents to the use of images for marketing, promotional purposes, and portfolio display, including:

    • Website galleries

    • Social media (Instagram, Facebook)

    • Paid advertising campaigns

    • Publications

Opt-Out Option

  • By booking, Client consents to use of images for marketing, including website galleries, social media, and promotional materials.

  • Clients may opt-out of marketing or portfolio use by submitting a written request at or before the session.

  • A one-time administrative opt-out fee of $150 applies to cover:

    • Administrative work to track excluded images.

    • - Extra editing or gallery management.

    • Lost marketing exposure.

    • Legal documentation/record-keeping.

    • Custom client requests for private image delivery.

    Important

  • If images have already been published or scheduled for marketing use, the Photographer will make reasonable efforts to remove them but cannot guarantee complete removal.

    • Opt-out requests must be submitted prior to publication to ensure full compliance.

SECTION 11 — LIMITATION OF LIABILITY & INDEMNIFICATION

  • Photographer and staff not liable for indirect, incidental, or consequential damages.

  • Liability for claims limited to fees paid.

  • Client indemnifies Photographer against claims from third-party actions during services.

  • Photographer may suspend services due to unsafe conditions, natural disasters, or emergencies.

SECTION 12 — GOVERNING LAW & SEVERABILITY

  • This Agreement governed by the laws of British Columbia, Canada.

  • Disputes resolved in BC courts.

  • If any provision is invalid, remaining provisions remain enforceable.
